Terms of service

Terms of Use

Effective date: August 28, 2026

These Terms of Use (the “Terms”) govern your access to and use of the website colettefalchet.com and any related pages, features, content, communications, online services, and purchases that link to or reference these Terms (collectively, the “Site”). The Site is operated by Colette Falchet, LLC (“Colette Falchet,” “we,” “us,” or “our”), a limited liability company organized under the laws of the State of Florida, United States.

By visiting the Site, creating an account, submitting information, using guest checkout, communicating with us, or placing an order, you agree to these Terms and to any policies that are linked here, incorporated by reference, or presented at checkout. Please read them carefully and save or print a copy for your records. If you do not agree to these Terms, please do not use the Site or place an order.

1. Eligibility and Authority

You must be at least 18 years old, or the age of legal majority in your place of residence, to make a purchase through the Site. Purchases are intended for personal use by end clients and gift recipients, and not for unauthorized resale, diversion, or commercial exploitation. If you use the Site on behalf of a business, organization, or another person, you represent that you have authority to bind that party to these Terms. You are responsible for providing accurate, current, and complete information and for maintaining the confidentiality of any account credentials.

You may purchase through an account or, when available, as a guest. We reserve the right to suspend, refuse, restrict, or terminate account access, guest checkout, order submission, or any Site feature if information is incomplete, inaccurate, unverifiable, unauthorized, or inconsistent with these Terms, our security practices, applicable law, or fraud-prevention requirements.

2. About the Site

The Site presents fine jewelry, editorial material, information about the Maison, and related services. We may add, remove, suspend, or modify any part of the Site, product offering, or service at any time. Access may occasionally be interrupted for maintenance, security, technical reasons, or circumstances beyond our reasonable control.

The Site is hosted by Shopify and may rely on Shopify, payment processors, shipping carriers, analytics providers, and other service providers to operate the Site, process orders, prevent fraud, and communicate with clients. These third parties may process information in accordance with their own terms and privacy practices. Please review our Privacy Policy for further details.

3. Product Presentation and Natural Variation

We seek to present each piece with care and accuracy. Fine jewelry is experienced through scale, light, movement, texture, and natural materials; screens and photography cannot reproduce every nuance. Color, proportion, scale, and finish may appear differently depending on the device, lighting, display settings, and photography.

Diamonds, colored gemstones, pearls, mother-of-pearl, and other natural materials are individually formed and may display variations in color, tone, luster, orient, inclusions, surface characteristics, shape, size, and pattern. These natural distinctions are part of the identity of a piece and are not, by themselves, defects. Handmade and hand-finished elements may also vary subtly from one piece to another.

Measurements and weights are approximate. Carat weights may be described individually or in total, as indicated. Product descriptions, origin statements, treatments, certificates, and grading information are based on information available to us and, where applicable, supplied by our artisans, laboratories, or vendors. Certifications, authenticity documents, gemstone reports, and similar materials are part of the information available for a piece and do not expand any warranty unless expressly stated in writing.

4. Availability, Pricing, and Corrections

Products may be one-of-a-kind, made in limited quantities, made to order, or subject to material availability. Placing an item in a shopping bag, cart, wish list, or checkout flow does not reserve the item, guarantee availability, or create a contract of sale. We may limit quantities, decline or cancel an order, or discontinue an item when reasonably necessary, including when an item is unavailable, a pricing or description error occurs, payment cannot be authorized, fraud is suspected, shipping restrictions apply, verification cannot be completed, or the order appears inconsistent with these Terms.

Prices are shown in the currency displayed on the Site and may change without notice before an order is accepted. Applicable sales tax, duties, shipping, insurance, and other charges will be shown or described during checkout when available. We aim to avoid errors, but if a material pricing, availability, or product-description error is discovered after an order is submitted, we may contact you for instructions, decline or cancel the affected order, and issue any refund required by law or our stated policy.

5. Orders and Acceptance

An order submission is an offer to purchase. Before submitting an order, you agree to review the selected piece, quantity, price, taxes, shipping charges, delivery details, billing information, personalization, sizing, engraving, and all other order details carefully. An automated acknowledgment confirms that we have received the order request and does not constitute acceptance. We accept an order only when we expressly confirm acceptance, charge your payment method, or dispatch the piece, as applicable. We may request identity, billing, payment, delivery, or other verification before acceptance. You authorize our service providers and us to use the information reasonably necessary to review, verify, process, and fulfill the order.

You are responsible for reviewing names, engraving, sizing, delivery details, contact information, and all specifications before submitting an order. You must contact the Concierge promptly if a correction is needed. Production and fulfillment may begin quickly, and we are not obligated to accept changes after an order has been submitted, except as required by law or expressly agreed in writing.

Our records, including electronic records of checkout activity, order acknowledgments, confirmations, payments, shipment information, client communications, and incorporated policies, may be used as evidence of the transaction and the agreement between you and Colette Falchet, LLC, to the extent permitted by law.

6. Bespoke, Personalized, Resized, and Made-to-Order Pieces

Bespoke, personalized, engraved, altered, resized, and made-to-order pieces may be governed by additional written specifications, estimates, timelines, deposits, approvals, and cancellation terms provided before work begins. Client approval of a design, rendering, stone, inscription, size, or specification authorizes production in accordance with that approval. Unless expressly stated otherwise in writing or required by law, bespoke, made-to-order, personalized, engraved, resized, altered, special-order, and final-sale pieces are not eligible for return or exchange. Renderings and sketches are illustrative and may not capture every nuance of a finished handcrafted piece.

Unless expressly agreed otherwise in a written agreement signed by us, all design concepts, drawings, renderings, prototypes, techniques, specifications, sourcing strategies, creative direction, and other creative or technical materials remain the intellectual property and confidential business information of Colette Falchet, including when developed in connection with a client commission.

7. Payment, Taxes, and Fraud Prevention

Payment is processed through Shopify and/or other third-party payment providers made available at checkout. Their terms and privacy practices may apply. You represent that you are authorized to use the payment method submitted and authorize the applicable charges. We do not guarantee that any particular payment method will remain available.

You are responsible for all taxes, customs duties, import charges, brokerage costs, currency-conversion costs, bank fees, or governmental assessments associated with an order unless we expressly state in writing that they are included. For international returns or exchanges, duties, customs charges, taxes collected by local authorities, brokerage fees, return shipping, and insurance remain your responsibility unless applicable law requires otherwise. We may conduct verification, screening, sanctions review, fraud review, or payment authentication and may delay, decline, or cancel transactions when reasonably necessary to protect clients, the Maison, our service providers, or legal compliance interests.

We may refuse, cancel, restrict, or delay any transaction, shipment, service, return, exchange, account access, or Site access where required or advisable under sanctions, export-control, anti-money-laundering, customs, fraud-prevention, or other legal or compliance obligations. We may also request additional information or documentation when reasonably necessary to complete review, verification, customs clearance, delivery, or regulatory compliance.

8. Shipping, Delivery, Title, and Risk

Shipping availability, timing, signature requirements, insurance arrangements, and geographic restrictions are described at checkout, or in direct communications concerning an order. Delivery dates are estimates unless expressly guaranteed in writing. If no shipping timeframe is stated, we will handle the order in accordance with applicable law, including any required notice, consent, cancellation, or refund rights for delayed shipments. High-value shipments may require an adult signature, identity verification, an approved delivery location, or additional coordination.

For security and fraud-prevention reasons, certain delivery details may be provided only after an order is reviewed, verified, or accepted. Delivery dates are estimates unless expressly guaranteed in writing. If no shipping timeframe is stated, we will handle the order in accordance with applicable law, including any required notice, consent, cancellation, or refund rights for delayed shipments. High-value shipments may require an adult signature, identity verification, an approved delivery location, delivery appointment, carrier hold, or additional coordination. You agree to cooperate with reasonable delivery, customs, security, and identity-verification requirements.

Title and risk of loss transfer as provided by applicable law and the shipping terms disclosed for the order. Refused deliveries, inaccurate addresses, missed signature attempts, customs delays, security reviews, carrier holds, and events outside our reasonable control may affect timing and may result in additional charges where permitted by law. You must inspect the external package upon arrival and contact the Concierge promptly regarding loss, visible damage, tampering, a delivery discrepancy, or a return or exchange request. Failure to notify us promptly may affect available remedies to the fullest extent permitted by law.

9. Returns, Exchanges, Warranty, and Care

Purchases are governed by the Return & Exchange Policy in effect when the order is placed, together with any specific written terms provided for bespoke, personalized, resized, altered, engraved, or special-order work. The Return & Exchange Policy and the Warranty & Care Guide are incorporated into these Terms by reference and form part of the agreement between you and Colette Falchet, LLC for any applicable purchase. Return or exchange requests must be made through the Concierge within the timeframe stated in the Return & Exchange Policy, and all returns or exchanges require prior authorization and must follow the secure shipping instructions provided. You must retain proof of return shipment and tracking information. Pieces returned without authorization, without required documentation, through an unapproved carrier, outside the authorized timeframe, or without satisfying condition requirements may be refused and returned to the client at the client’s cost where permitted by law. Eligibility, timing, condition requirements, exclusions, inspection procedures, refund timing, and responsibility for shipping, insurance, duties, taxes, customs charges, or brokerage fees are stated in those policies or in the applicable written order terms. We will honor any non-waivable return, cancellation, warranty, or refund rights required by law.

Our Warranty & Care Guide explains applicable craftsmanship coverage, exclusions, inspection procedures, and appropriate care for fine jewelry, pearls, natural gemstones, metals, and finishes. Normal wear, accidental damage, improper handling, unauthorized repair or alteration, chemical or heat exposure, and failure to follow care guidance may fall outside available coverage, subject to applicable law.

After-sale services, repairs, resizing, cleaning, inspection, replacement parts, or other service requests may be subject to separate assessment, estimates, timelines, limitations, and service terms. Unauthorized repair, modification, resizing, stone-setting, refinishing, or service performed by a third party may affect eligibility for warranty coverage, repair support, return, exchange, or refund, subject to applicable law.

Nothing in these Terms limits a non-waivable consumer right or remedy available under applicable law.

10. Editorial and Informational Content

Journal articles, interviews, stories, guidance, and other editorial content are provided for general informational and inspirational purposes only. Colette’s Journal is a private, invitation-only editorial space. You do not acquire any right to access the Journal unless we personally grant access.

We reserve the right, in our sole discretion and to the fullest extent permitted by law, to grant, decline, limit, suspend, or withdraw Journal access at any time. Any invitation is personal, confidential, non-transferable, and intended only for the recipient identified by us unless we expressly state otherwise in writing. Access to Colette’s Journal may require registration, authentication, acceptance of an invitation, or other access controls determined by us.

Journal content does not constitute medical, psychological, legal, financial, investment, or other regulated professional advice and is not a substitute for advice from a qualified professional familiar with your circumstances.

11. Intellectual Property

The Site and its contents—including the Colette Falchet name and marks; designs; jewelry concepts; collection names; text; essays; photographs; video; audio; illustrations; graphics; layouts; logos; packaging; certificates; source identifiers; trade dress; and the selection and arrangement of content—are owned by or licensed to Colette Falchet or its licensors and are protected by copyright, trademark, trade dress, design, intellectual-property, and unfair-competition laws.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site solely for personal, noncommercial purposes. Except where applicable law expressly permits otherwise, you agree not to reproduce, distribute, display, publish, modify, translate, reverse engineer, scrape, mine, crawl, index, frame, mirror, sell, license, create derivative works from, remove proprietary notices from, use to train artificial-intelligence systems, or otherwise commercially exploit any Site content without our prior written permission.

By accepting these Terms, accessing Colette’s Journal, or receiving any invitation to the Journal, you agree that access is personal, confidential, and non-transferable. You agree not to forward, copy, reproduce, publish, archive, upload, distribute, substantially quote, screenshot, summarize for republication, adapt, translate, post, transmit, or otherwise share any Journal essay or protected portion of the Journal with any person or platform without our prior written permission. You also agree not to use Journal content for commercial purposes, training artificial-intelligence systems, competitive analysis, or any public or private republication.

12. Communications, Submissions, and Feedback

When you send an inquiry, review, photograph, testimonial, suggestion, idea, or other material, you represent that you have the right to do so and that the material is lawful and accurate. You retain ownership of your original content. Unless we separately agree otherwise, you grant us a worldwide, non-exclusive, royalty-free license to use, sublicense, reproduce, adapt, publish, and display content for publication, promotional use, and internal improvements,  in its complete form or any part, the material that you intentionally submit. Private client communications, bespoke specifications, and personal information remain subject to our Privacy Policy and any separate confidentiality commitment.

You agree not to use the Site to:

  • violate any law, infringe another person’s rights, misrepresent your identity, or engage in fraud;

We reserve the right to restrict, suspend, or terminate access, cancel or refuse an order, remove content, preserve evidence, investigate suspected misuse, cooperate with lawful requests, or take other protective action if we reasonably believe these Terms, any incorporated policy, applicable law, security requirements, intellectual-property rights, or the integrity of the Maison have been violated.

14. Third-Party Services and Links

The Site may connect to Shopify, payment processors, delivery providers, social platforms, analytics providers, fraud-prevention vendors, communication providers, or other third parties. Third-party services are governed by their own terms, privacy practices, security practices, and policies. Links are provided for convenience and do not imply endorsement, sponsorship, approval, or responsibility for the third party. Your use of the Site may involve cookies, pixels, analytics tools, and similar technologies as described in our Privacy Policy and, where applicable, our cookie notice or consent settings.

15. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, ITS CONTENT, AND ANY ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES REGARDING THE SITE AND ONLINE SERVICES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PRODUCT WARRANTIES, IF ANY, ARE LIMITED TO THOSE EXPRESSLY PROVIDED IN THE WARRANTY & CARE GUIDE, IN A WRITTEN WARRANTY DOCUMENT PROVIDED WITH A PIECE, OR REQUIRED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS. NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COLETTE FALCHET, LLC AND ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, ARTISANS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SITE, A PIECE, AN ORDER, A SERVICE REQUEST, ANY INCORPORATED POLICY, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SITE, A PIECE, AN ORDER, A SERVICE REQUEST, ANY INCORPORATED POLICY, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE PIECE OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT OR (B) US$100. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING WHERE APPLICABLE LAW DOES NOT PERMIT A LIMITATION FOR FRAUD, INTENTIONAL MISCONDUCT, GROSS NEGLIGENCE, PERSONAL INJURY, OR NON-WAIVABLE CONSUMER RIGHTS.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Colette Falchet, LLC and its affiliates, personnel, artisans, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable expenses, including reasonable attorneys’ fees, arising from your unlawful misuse of the Site, your violation of these Terms or any incorporated policy, your violation of law, your fraud or misrepresentation, your misuse of a piece or service, or your infringement of another person’s rights. This provision does not require you to indemnify us for our own unlawful conduct, gross negligence, or willful misconduct.

18. Dispute Resolution, Arbitration, and Individual Claims

IMPORTANT NOTICE: BINDING ARBITRATION AND CLASS ACTION WAIVER. This section affects your legal rights. To the fullest extent permitted by law, you and Colette Falchet, LLC agree that disputes will be resolved by binding arbitration on an individual basis, and not in court before a judge or jury or as part of any class, collective, consolidated, representative, or private-attorney-general proceeding. This arbitration agreement is governed by the Federal Arbitration Act.

Before either party initiates arbitration or a permitted court proceeding, the party raising the dispute must first provide written notice describing the nature of the dispute, the relief requested, and the information reasonably necessary to evaluate the matter. The parties shall make a good-faith effort to resolve the dispute informally for thirty days after notice is received, unless a shorter period is required to preserve a legal right or seek urgent relief.

Any dispute, claim, or controversy arising out of or relating to the Site, a piece, an order, these Terms, any incorporated policy, or any relationship or transaction between you and Colette Falchet, LLC shall be resolved exclusively by binding arbitration, except as expressly provided in this section or where prohibited by applicable law. The arbitration shall be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, or by another mutually agreed arbitration provider if the American Arbitration Association is unavailable or declines administration. Unless applicable consumer rules or non-waivable law require otherwise, the arbitration may be conducted by video conference, telephone, written submissions, or at another location or in another manner determined by the arbitrator or agreed by the parties.

Either party may bring an individual claim in small-claims court if the claim qualifies and remains in that court. Either party may also seek temporary or preliminary relief in court when necessary to protect intellectual property, confidential information, security, or property interests. Any court proceedings permitted under this section shall be brought in the state or federal courts located in Miami-Dade County, Florida, United States, unless a non-waivable law requires otherwise.

To the fullest extent permitted by law, you and Colette Falchet, LLC waive the right to a jury trial and agree that each may bring claims against the other only in an individual capacity. No arbitration or court proceeding may be brought, maintained, or resolved on a class, collective, consolidated, representative, or private-attorney-general basis, unless this waiver is found unenforceable for a particular claim or remedy as provided below.

If any portion of the arbitration requirement, jury-trial waiver, or class, collective, consolidated, representative, or private-attorney-general waiver is found unenforceable as to a particular claim or request for relief, that claim or request may proceed only to the extent required by law, and the remaining claims and remedies shall be resolved in arbitration to the fullest extent permitted. Nothing in this section limits any non-waivable consumer right or remedy available under applicable law.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where the Federal Arbitration Act governs the arbitration agreement above or where the mandatory consumer law of your place of residence applies. Subject to the dispute-resolution and arbitration provisions above, and to any non-waivable right, claims that are not required to be arbitrated shall be brought in the state or federal courts located in Miami-Dade County, Florida, United States, and each party consents to their jurisdiction and venue.

20. General Provisions

If any provision is held unenforceable, that provision will be enforced to the greatest lawful extent, and the remaining provisions will continue in full force and effect. Our failure or delay in enforcing any provision does not constitute a waiver of that provision or any other right. We may assign, transfer, or delegate these Terms, in whole or in part, in connection with a reorganization, financing, merger, sale, transfer of assets, or transfer of all or part of our business. You may not assign, transfer, or delegate your rights or obligations without our prior express written consent. These Terms, together with incorporated policies, order confirmations, service terms, and any specific written order terms, constitute the entire agreement regarding their subject matter and supersede prior or contemporaneous communications about that subject matter, except where a separate written agreement expressly states otherwise.

21. Changes to These Terms

We reserve the right to update these Terms to reflect changes in the Site, our products, our services, our practices, legal requirements, or operational needs. The revised version will be posted with an updated effective date. Changes apply prospectively unless applicable law permits or requires otherwise. Your continued use of the Site, access to Colette’s Journal, submission of information, communication with us, or placement of an order after the effective date constitutes acceptance of the revised Terms.

22. Language

Translations may be provided for convenience. To the extent permitted by applicable law, the English-language version is the official and controlling version if a discrepancy arises.

23. Contact

If you have questions about these Terms, need assistance with an order, wish to request a return or exchange, or need to send a legal notice, please contact our Concierge at concierge@colettefalchet.com.
